Terms & Conditions

1. Purpose
These Terms and Conditions govern the relationship between YallaKech ("the Agent"), acting as a booking intermediary, and any person booking a service through the Agent ("the Client"). Services are delivered by independent local partners ("the Providers") and are described on the YallaKech website.

2. About the Agent
YallaKech is a local concierge and booking service based in Marrakech, Morocco, connecting travellers with independent local partners for all services offered on our website. WhatsApp: +212 6 53 50 04 20 — Email: contact@yallakechmarrakech.com

3. Booking

Bookings can be made through the YallaKech website, WhatsApp, or email. The booking process works as follows:

  1. The Client submits a booking request via the YallaKech website, WhatsApp, or email.
  2. The Agent checks availability with the relevant Provider.
  3. Once availability is confirmed, the Agent sends the Client a confirmation by WhatsApp or email, including the date, time, meeting point, and price.
  4. Payment is made directly to the Provider, in cash, on the day of the activity (see Section 4 – Payment).
  5. The booking is considered confirmed once the Client has received this confirmation from the Agent.

Until availability has been confirmed by the Provider, no booking can be guaranteed.

4. Payment
Payment is made directly to the Provider, on-site, on the day of the activity, in cash only — Moroccan dirhams or euros are accepted. No online payment is required to confirm a booking. In exceptional cases, such as high season or larger groups, the Agent may request a deposit to secure a booking. Where applicable, this will be clearly communicated to the Client before confirmation.

5. Cancellation and Modification

Any request to cancel or modify a booking must be sent by WhatsApp or email.

Modifications are subject to the Provider's availability and agreement, and may be subject to additional charges applied by the Provider.

Clients are kindly asked to inform the Agent at least 24 to 48 hours before the scheduled activity. That said, last-minute requests are always welcome — the Agent will do its best to accommodate them, subject to availability.

Where a deposit has been collected by the Agent (see Section 4 – Payment):

  1. If the cancellation is made more than 24 hours before the activity, the deposit will be refunded.
  2. If the cancellation is made less than 24 hours before the activity, or in the event of a no-show, the deposit will not be refunded.

6. Liability

YallaKech acts exclusively as an intermediary between the Client and the Providers. The Agent selects reputable local partners but does not itself perform, supervise, or guarantee the execution of any activity, excursion, or service.

Accordingly, YallaKech cannot be held responsible for:

  • the execution or quality of a service;
  • a change in staff, schedule, or itinerary made by a Provider;
  • a delay, exceptional closure, or cancellation decided by a Provider;
  • any dispute between the Client and a Provider;
  • an accident, injury, illness, or medical issue occurring during an activity;
  • theft, loss, or damage to personal belongings;
  • any other event occurring during or in connection with a service.

Any complaint regarding the execution of a service should be addressed directly to the relevant Provider.

Activities such as quad biking, buggy tours, camel rides, and horse riding carry inherent risks. Clients must be in suitable physical condition to take part, and must follow the safety instructions given by guides and Providers at all times. A minimum age of 16 applies to driving a quad or buggy.

7. Force Majeure

Neither the Agent nor the Providers can be held responsible for any delay or failure to perform resulting from a force majeure event, including but not limited to natural disasters, war, terrorist attacks, pandemics, government decisions, administrative closures, transport disruptions, or any other event beyond the reasonable control of the parties.

8. Data Protection

  • Data Controller — YallaKech ("the Agent") is responsible for processing personal data collected through its website and contact channels (WhatsApp, email). Contact: contact@yallakechmarrakech.com.
  • Data Collected — When making a booking or contacting the Agent, the Client's personal data may include: full name, phone number, email address, nationality, travel dates, and activity preferences.
  • Purpose of Processing — This data is used to process and confirm bookings, contact the Client before and during their stay, provide customer support, respond to enquiries, and, with consent, share offers and updates.
  • Legal Basis — Processing is based on the performance of the contractual relationship (booking a service) and, where applicable, the Client's consent for marketing communications.
  • Data Sharing — Personal data may be shared with the Providers strictly necessary to fulfil a booking (guides, local partners, restaurants). YallaKech does not sell or rent personal data to third parties for commercial purposes.
  • Data Retention — Data is retained for as long as necessary to process the booking, and archived thereafter for a reasonable period for accounting and legal purposes, before deletion or anonymisation.
  • Cookies — The website may use essential cookies required for its operation, as well as audience-measurement cookies. Clients can configure their browser to refuse non-essential cookies.
  • Client Rights — Clients have the right to access, rectify, and request the deletion of their personal data. These rights may be exercised by contacting contact@yallakechmarrakech.com.

9. Complaints
Any complaint may be sent by email to contact@yallakechmarrakech.com. The Agent will respond within a reasonable timeframe.

10. Governing Law and Jurisdiction
These Terms and Conditions are governed by Moroccan law. In the event of a dispute, the parties agree to seek an amicable solution before initiating any legal proceedings. Failing an amicable resolution, the courts of Marrakech, Morocco shall have exclusive jurisdiction.
